Wills & Probate - Inheritance Claim
In certain cases it is sometimes possible to contest the Will of somebody who has died.
Although a person is usually free to leave their estate to whomever they want to, a challenge can be brought if they have not made provision for their dependants. For example, a surviving husband or wife, children under the age of 18 and other people who may have been dependant on that person before he or she died.
It is sometimes possible to challenge the validity of a person's Will after they have died if it can be proved that the person did not have the mental capacity to make the Will in the first place or if the strict formalities of executing have not been complied with.
