Private Landlord - Letting your property
If you are a Landlord there are a number of legal formalities you will need to follow. The legal starting point, is always the tenancy agreement known as an Assured Shorthold Tenancy Agreement which is usually for either 6 or 12 months. We can advise you as to the construction of the tenancy agreement and will draft this document for you taking into account any special provisions you may wish to include.
Following the end of the tenancy agreement after either 6 or 12 months the agreement automatically converts into a Statutory Periodic Tenancy which can usually be ended by the providing to the tenants 2 months notice in writing.
Tenancy Agreement Disputes
Occasionally, a landlord may have problems with their tenant; either because the tenants have not paid the rent or sometimes because they have damaged your property or have not complied with a provision in the tenancy agreement. A simple letter to the tenants may be enough to resolve the problem. If this does not work, you may wish to start proceedings to evict the tenants so that you can get the property back. It is essential that the correct legal formalities are followed as an unlawful eviction could result in a landlord being prosecuted. Our dispute resolution team can for a fixed fee make an application for a Possession Order in the County Court nearest to the property.
