If your marriage or civil partnership has broken down you may want advice on divorce or dissolution. Divorce or dissolution is an administrative process and you do not usually have to attend at Court. This process puts you back to being single again. The legal term for this is a Decree Absolute or Dissolution order.
A Decree absolute following a divorce or dissolution proceedings will only end your marriage. It will not provide for a financial settlement in terms of your assets or income. In order to make sure that on divorce or dissolution you get your fair share of the family assets you may have worked together to build up, we always recommend that you have a final financial order containing all the details. A financial order can only be made on a divorce or dissolution. If we cannot reach a settlement by negotiation it may be necessary to start financial proceedings in a County Court in Cheshire. As an alternative to Ancillary relief, you may want to consider settling your financial dispute using the Collaborative system. This relatively new way of settling finances originated in the USA and is now starting to be used in England and Wales. Collaborative requires both parties to enter into an agreement with their Solicitor and their former partner that they will set aside their differences and work together in an amicable way to reach a settlement without starting Ancillary Relief.
